Release of Liability: Upon registering for a trip / photo tour, participants certify that they have carefully read the dates, schedule of activities, the requirements and the “Terms and Conditions” for the trip / photo tour. They are aware that the trip / photo tour involves the risk of personal injury, death or loss (damage) to property. Taking into consideration the benefits obtained by the trip / photo tour, the participants recognize and voluntarily accept all the risks thereof. Participants agree on their behalf, their dependents, heirs, executors and assigns, to release and exempt Pictury Photo Tours, its legitimate representative José Manuel Domingues Ferreira dos Santos (hereinafter referred to as “Tour Operators”) and family, subsidiaries, affiliates, directors, successors, representatives, affiliates and their designated tour operators from any and all claims, including, but not limited to liability for delays, monetary damages, illness, injury, death or for loss or damage to property resulting directly or indirectly from any occurrences or conditions. Participants agree to abide by the conditions set forth under the”Terms and Conditions” and other sections as stated herein or elsewhere published.
Participants affirm that they are covered by medical insurance, which is valid in Portugal and state that they have not relied on any additional oral or written representation of the Tour Operators for executing this trip / photographic tour. Participants also acknowledge receipt of this communication and understand and accept its terms and conditions. All the questions and doubts the participants had about this communication were answered completely.
The Tour Operators organize, promote and sell the travel / photo tour along with services they buy from other suppliers. The suppliers are independent contractors and are not agents or employees of Tour Operators. They provide services that include, but are not limited to, transportation, accommodations, meals. Despite the effort to make agreements with reputable suppliers, Tour Operators are not responsible for the voluntary or negligent acts or omissions of such suppliers, employees, agents, employees or representatives, including, without limitation, failure or inadequate service delivery.
All travel and arrangements are subject to the terms and conditions specified by the suppliers, air carriers and / or applicable governing laws. Tour Operators and suppliers providing transportation or any service cannot accept any liability for additional loss or expense due, but not limited to, delay, inconvenience, change or cancellation of itinerary, illness, weather, strike, war, quarantine, terrorism, defects in vehicles, damage to equipment, animals, including transportation by animals, hiking, and any act, omission, negligence or other causes that go beyond your control. All such losses or expenses will be borne by the participant, since the contracted travel / photo tours rates provide for arrangements only for the time stated. Tour operators are not responsible for expenses incurred by participants in preparing for travel (ie air tickets, visa / passport fees, equipment, medical expenses, individual transfers, etc.).
Assumption of Risk: Participants voluntarily enroll in the travel / photo tour with knowledge that it involves inherent risks and danger, including, but not limited to, forces of nature, terrorism, civil unrest, strikes, wild animals (including animals used for transportation), all activities, including hiking over rough terrain, theft, cancellation or changes in itinerary, negligent action of third parties or their agencies. On trips /photo tours of this type, it is not possible to accommodate people with serious health problems, physical disabilities or mental illness. It is the responsibility of the participant to evaluate their suitability for the activities of the trip / photo tour to their own physical and mental capacities. By paying the deposit, the participant certifies that he / she agrees to these terms and conditions and that he / she has no mental or physical condition or other condition that would create a risk for him or other participants. Tour Operators and their suppliers assume no responsibility for special agreements or problems incurred by participants who cannot / should participate in the travel / photo tour or planned activities. It is reserved for Tour Operators the right to refuse anyone as a participant in the travel / photo tour, or to require any participant to leave the trip at any time.
Fitness and Health: Anyone who is reasonably fit should be able to participate in most of the activities on the Trip/Tour. It is possible to experience general fatigue due to long flights and changes in time zones. The participant will need to be agile enough to get in and out of the transport vehicles to be used during the travel / photo tour and be able to transport and handle his own photographic equipment and his suitcases. The travel / photo tour participants will hike trails and paths that vary from easy to moderate during the whole trip. If the participant has any special needs or any physical condition that he / she feels may prevent him / her from participating fully, he / she must inform the Tour Operators when signing up for the trip / photo tour and send an email with their questions or concerns. It should be noted that medical services and facilities may not be readily available during all or part of the travel / photo tour. This may include emergency medical care, the presence of doctors, or appropriate medications. Participant must first advise Tour Operators of any allergies, physical / mental conditions or medications they are currently taking that may affect their health.
Changes in Services: We reserve the right to change our prices. Accommodations are based on double occupancy (two people sharing a room). Requests for individual occupancy are assigned on a first-come, first-served basis and will be serviced wherever possible and subject to an additional fee at the rate indicated on the specific travel / photo tour website page. Tour Operators reserve the right to cancel or make changes to the planned itinerary, including replacing leaders of the trip / photo tour, whenever they deem it necessary, without consulting the participants. Participants have no right to any refund or other considerations in the event of such itinerary or leader changes. The Tour Operators reserve the right to cancel any Trip before departure, in which case a full refund of all amounts paid to the Tour Operators will be made. If changes are made, tour leaders will plan each day considering the interests of the group and the weather at hand. Be assured that we will make substitutions that are similar in quality and interest when possible
Code of Conduct: Participants are expected to behave respectfully towards the group and other participants. Any use of drugs or illegal substances, committing or engaging in any criminal or illegal activity and violence of any kind will not be tolerated and will result in the immediate expulsion of the participant from the trip / photo tour, without reimbursement and at his / her expense. Trip leaders / photographers are authorized and therefore reserve the right to exclude participants from the trip / photographic tour or any part of it for actions they deem inappropriate or disturbing to the group.
Indemnification: Participant agrees to defend and indemnify operators against any and all claims, demands or lawsuits (including, without limitation, claims, claims or lawsuits), actions, liabilities, damages and costs, losses and / or expenses (including fees and reasonable attorneys’ fees) (collectively, “Claims and Damages”) that the Tour Operator may incur, suffer or be required to pay in respect of actions taken by the participant, including those resulting in damages to property of third parties, or any other Claims and Damages arising from a third party claim due to actions taken by the participant. The participant is obliged to reimburse the Tour Operators for any Claims and Damages required by third parties during the trip / photographic trip or after, as a result or related to actions taken by the participant.
Airfare: Airfare is NOT included in the travel / tour prices provided. Before booking your air ticket, contact the Tour Operator or any of its members to know the arrival and departure times of your flight. The Tour Operator cannot accept any responsability for losses or additional expenses on airfare due to trip cancellation or alteration. We suggest booking a refundable fare or purchasing the optional insurance in case the Trip must cancelled, postponed or altered.
Included in the price of travel / photo tour: Ground transportation in group for the activities planned in the trip / tour. Accommodation based on double occupancy (two people sharing a room). Individual occupancy requests are allocated on a first-come, first-served, first-served basis, and are subject to an additional fee indicated on the specific travel / photo tour website page. Driver services (if applicable). The services of the photographic leaders throughout the trip / photographic tour. Meals as provided on the specific trip / photo tour website page. Tickets, entrance tickets, all tours and guides listed and provided on the site page of the specific travel / photo tour.
NOT Included in travel costs: domestic or international airfares to and from the start and end places of the trip / photo tour; tax and fees on air tickets; airport departure tax (if applicable); transfers / transport to and from the airport; additional transfers or accommodations that may be required by those who do not travel with the group; excess baggage; meals / snacks not included as indicated on the specific trip / photo tour website page; parallel activities carried out on own account; passport / visa expenses; individual costs of medical or travel insurance; any personal expenses such as room service, laundry, beverages, unplanned meals and alcoholic beverages; medical expenses; photographic equipment; any activity not specified in the itinerary of the specific trip or photo tour that is listed as optional, or any item not listed on what is included in the specific trip / photo tour information page on our site; exchange surcharges.
Single / double accommodation: A limited number of single rooms are available at an extra cost in the “first come / first served” principle. We will assist people who request a certain type of roommate. Participants will be informed when it is not possible to arrange a roommate, in which case the one-time fee will be charged.
Payments, cancellations and refunds: One deposit per participant is required at the time of booking a place. The required deposit amounts will appear on the specific travel / photo tour page on our website. Full payment is required when booking is made less than 30 days prior to travel / tour date. The booking is subject to cancellation by tour operators if the payments are not received on the scheduled dates. If a participant wishes to cancel, they must send a notification by email. Please note that the cancellation is not effective until you have received a reply email confirmation acknowledging your cancellation. At the moment we receive your cancellation notification charges will be applied per person according the conditions of the specific photo travel/tour page. If your place is filled by another participant, we will refund the deposit less the payment processing fees and the administrative fee of € 50. 30 days or less before departure or at any time after departure: NO REFUNDS will be issued and the deposit will be withheld. Full payment must be made no later than 30 days prior to departure confirmation of the tour. If the total and final payment is not received by this date, the participant will be notified via email twice requesting the final payment. After that, we will consider your failure to pay which will result in the cancellation of your trip / photo tour registration and will be given as lost and will be available to other interested parties on the waiting list.
Travel insurance: Each participant confirms that he understands and agrees to make the insurance mentioned below, which is valid internationally, and that he undertakes to send proof of his existence before departure for the trip.
Coverage Required: Accident and illness Coverage of medical expenses (minimum € 100,000) Emergency evacuation and repatriation of remains (minimum € 200,000) Accidental Death / Dismemberment Travel Cancellation Coverage Suggested additional coverage: Hospital ward and picture Coverage of Baggage and Personal Accidents Travel Delay / Interruption Header visitor We strongly recommend that you evaluate your risk and take out travel insurance that covers the total amount of travel and personal loss in the event of cancellation of travel, loss or theft of luggage and emergency evacuation. Tour Operators their owners, agents and subsidiaries shall not be liable for such expenses. It is vital that the participant realize that if he is delayed or has to cancel or interrupt the trip for any reason, he will lose part or the sum of the amount paid (see the section “Deposits, payments, cancellations and refunds” under the terms and conditions above). Travel insurance helps minimize the risk of financial loss you would incur in the event of a delay in your departure due to weather, air strike, missed connection, etc., your inability to travel for reasons such as illness, injuries, unforeseen financial complications, and other personal circumstances, or if it were necessary to interrupt travel for medical or other reasons. There are restrictions and limitations on any insurance program. For this reason, we recommend that you carefully read the fine print of your insurance policy.
Compensation Release: Tour Operators and photographic travel / tour leaders reserve the right to make photographs or videos during tours or part of them and use the resulting photographs, videos or recordings for promotional or commercial use. By making a booking at Pictury Photo Tours, the participant agrees to allow his or her image to be used by Pictury Photo Tours and its representatives without any compensation to the participant. If the participant prefers that his / her image not be used, you must notify Pictury Photo Tours in writing before departure.
Copyright: The copyright in all photographs, videos, and related materials (hereinafter referred to as “travel materials”) created by the entrant must belong to you after creation. Participant grants to Tour Operators, their owners, agents and subsidiaries a non-exclusive, worldwide, irrevocable license to use any Travel Material voluntarily provided to Tour Operators in any media for the following purposes: editorial use, promotion of such editorial use, advertising and promoting photo tours or workshops offered by tour operators or promoting photo tours or workshops led by tour leaders representing tour operators.
Food and Beverages: Breakfast is always included in the price of the accommodation and will be served at the hotel where the group is staying. There are some meals included depending the type of photo travel/tour and according the conditions of the specific photo travel/tour page. Any other meal not mentioned or any other type of consumption not foreseen is the responsibility of each participant.
Dispute Resolution: If the participant has a complaint, they must first inform the tour operator or the leader of the trip during the travel / photo tour so that the tour operator or the leader of the trip can try to resolve and correct the matter. If the participant is still dissatisfied, they should send the complaint in writing to Pictury Photo Tours within 30 days of the end of the trip. Any controversy or claim arising out of or in connection with this Agreement, leaflets or any other literature on this photographic journey or trip, or its violation, including, without limitation, any claim relating to illness, injury or death shall be subject to the application of Portuguese law. The parties agree that they will attempt in good faith to resolve all disputes arising under or in connection with this Agreement. The maximum amount of recovery that a participant will be entitled under any and all circumstances will be the cost published by Pictury Photo Tours of the trip / photo tour.
Other: Additional Terms and Conditions may apply to some of our travel / photo tours and will be communicated in advance. By signing up for a Pictury Photo Tours organized and promoted by José Manuel Domingues Ferreira dos Santos, the participant agrees to the Disclaimer and the Terms and Conditions published on the site (www.picturyphototours.comtermos- conditions) or in any printed material.
Partcipants acknowledge that they have read, understand and agree to and will abide by all Terms and Conditions of participation in the travel / photo tour as set forth above. Participants confirm that they review and agree to the dates and costs of the travel / photo tour and that they understand that flights are not included in the cost. The full final payment is required 30 days prior to departure for the travel / photo tour or participants risk losing the deposit / sign and having their place lost to a participant on the waiting list. Participants will receive an invoice from Paypal via email requesting the final payment or they can send the payment through bank transfer or Paypal®. The participant can send us an email if they have any questions about the final payment.
